By accessing and using the Pack Beyond website (“Site”), you agree to comply with and be bound by these Terms and Conditions (“Terms”). Pack Beyond reserves the right to modify these Terms at any time without prior notice. Your continued use of the Site constitutes acceptance of any changes. Intellectual Property & Customer Content

All content on this Site, including but not limited to text, images, graphics, designs, and software (“Content”), is the property of Pack Beyond or its content suppliers and is protected by applicable intellectual property laws. Unauthorized use, reproduction, modification, or distribution of the Content is prohibited without prior written consent from Pack Beyond.

Customers submitting artwork, logos, or designs affirm that they own the rights or have legal permission to use them. Pack Beyond is not liable for any copyright infringement claims arising from customer-submitted designs. By submitting content, the customer grants Pack Beyond a non-exclusive, royalty-free license to use, modify, and display designs for processing orders and marketing purposes.

User Conduct

Users are responsible for any content they upload, post, or transmit through the Site. By using the Site, you agree not to:

• Upload or share content that infringes on any third-party intellectual property rights.
• Transmit content that is unlawful, defamatory, obscene, or otherwise objectionable.
• Interfere with the operation of the Site or other users’ enjoyment of it.

Pack Beyond reserves the right to remove any content that violates these Terms and to take appropriate legal action against violators.

Order Placement and Payment

All prices listed are in U.S. dollars (USD). Payment must be made in full at the time of order placement, including all applicable charges, shipping fees, and taxes. Orders will not be processed until payment is received.

Once an order is placed and confirmed, cancellations or modifications are not permitted after 24 hours.

Shipping and Delivery Risks

Pack Beyond aims to process and ship orders promptly. However, delivery times are estimates and may vary due to unforeseen circumstances. Pack Beyond is not responsible for delays, lost shipments, or damages caused by third-party carriers. Once the product leaves our facility, the risk of loss transfers to the customer.

Product Liability Disclaimer

Pack Beyond is not responsible for damages caused by improper handling, storage, or use of our packaging. Our liability is limited to the replacement of defective products only. If a packaging defect results in damage to the customer’s product, Pack Beyond is not liable for financial loss or damages beyond the cost of the packaging itself.

Returns and Refunds

Due to the custom nature of our products, returns and refunds are not accepted unless the products are defective or do not match the approved specifications. Customers must notify Pack Beyond within three (3) business days of receiving the order, providing digital proof of the defect.

If Pack Beyond determines that the defect is due to a manufacturing error, we will reprint the order at no additional cost. However, if the issue is due to customer-provided artwork or misinformation, the cost of reprinting will be the customer’s responsibility. The defective order must be returned within seven (7) business days to be eligible for reprinting.

Indemnification (Legal Protection from Lawsuits)

Customers agree to indemnify and hold Pack Beyond harmless against any claims, damages, or liabilities arising from:

• The use or misuse of our packaging.
• Claims that packaging infringes on intellectual property.
• Third-party claims made against the customer regarding product performance.

Pack Beyond is not responsible for any legal disputes, product recalls, or financial losses caused by improper use of packaging by the customer or their clients.

Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Pack Beyond operates, without regard to conflict of law principles. Any disputes arising from these Terms or the use of the Site shall be resolved exclusively in the competent courts of that jurisdiction.
